Local Law enforcement BS

As many of you may know I got a BS ticket for my trailer the weekend of the sanddrags, while it is frustrating enough, I heard that anyone from Out Of State that received a ticket that weekend is being forced to travel back to Amarillo to take care of it. Can anyone conferm that they will not handle it through the mail? After hearing this and them shutting No Name/ Pitbull down I have a really bad feeling in my gut. Anyone else had any problems lately?

I know that the City of Fort Worth has a manditory appearance in thier traffic court. I was in there one day and there was a guy from California complaining about having to come back for a court appearance and the Judge said that that is how it is.

I would understand if that were policy, but I have the option of mailing my ticket in. To me it just seems like they are trying to make anything associated with the river difficult. I have towed my trucks the same way for 5 years and never had a problem. Now I am worried I am going to get hassled every time I go out there.

They did say on the news "We'll be enforcing every possible law that we are able to that weekend."

From that, I'd say that you would only have that much trouble during that weekend. Not that it's right in the slightest but it is what it is I guess.

Mine? No idea. When I went in to plead not guilt, the lady at the court said she was about to call the DPS because she had no clue as to what he meant by "overwidth" there was no description or violation code of any kind. He didn't even specify if it was a truck or trailer.

The warning I got from Officer Wesley(whom I am sure some of you know)
with the DPS cited that my old trailer, the one I sold to Bullboy(Calvin)
of Lubbock, was not spec'd to carry the K5 due to the way the trailer
was registered...apparently, the title said it was "shop-built with a 1500lb
limit" sooo, after he wrote me up for a bum tail lamp, "incorrectly crossed"
safety chains and the overweight cargo, I was also informed that the K5
was too wide as well as too heavy to carry on the trailer I had...I was fortunate at the time, 'cause all the violations were written as warnings, not
tickets....that was about 5 years ago, and I haven't driven out N. Western
to catch the Loop on my way to the river since.....

anyway, Jer, you might have to re-register your trailer (check the title)
to avoid further hassles....

CheaperJeepers dad got a sticker violation. He is not out of state as he lives in Henrietta (I believe) Not sure if he could mail it in or if he has to appear. Maybe he will see this.

My trailer is registered to carry the weight, it is just a utility trailer and after I swapped axles I have to pull one side up on the rail. When the Officer pulled me over the conversation went something like this.

DPS: You couldn't find a bigger trailer?
me: No, this was all I had available this weekend.
DPS: Well I am going to have to right you a ticket for being overweight.
me: What exactly is overweight? I know the truck and trailer are not over 4500lbs.
DPS: You have tires sticking over the rail, that is Grossly Unsafe and I am writing you a ticket.
DPS leaves and spends over 45mins in his car. Comes back and say
DPS: I wrote you a ticket for being Overwidth, you really need to get a bigger trailer.
me: I know but they are not exactly giving those away right now.
DPS: Have a good day.

He had me pulled over for about an hour that morning. As best I can find the only thing regarding overwidth laws are for loads over 8'6". My trailer is narrower than the mirrors on my tow truck. So I don't see how that could apply. I figure they were writing as many tickets as they could and banking on people not to fight them.

Man that stinks.I guess I got lucky as hell.I hauled my jeep down on a lil single axle trailer (think its ment for lawnmowers).Guess Im in the market for a trailer.But as far as the ticket, fight it more than likely the officer wont show up and theyll dismiss it,hopefully.Good luck.

Thats just it, I can't find anything that would make that against the law. If you can, please post it here. Is it the best way to haul a truck, no. Is it Grossly Unsafe? I can't see the truck coming off the trailer....I would venture to say it is less likely to come off the trailer than a truck loaded on a car hauler with the tires near the edge. It doesn't bother you that they can pull you over for no reason. I guess what eats at me the most is the fact that "we" have been trying to promote the sport in our area and get people to enjoy the river, then local LEO are trying to discourage it.

for what it's worth, many traffic laws are enforced
to certain degrees based on the Officers' discretion,
and only after you get in front of the Judge can you
dispute and or have the offense overturned....


In a nutshell, it can wholly depend on the cop's mood...
not moral, but that's just how it is...




(I spoke to my father-in-law,and this is basically what he told me)

I will never make that mistake again. Last time i fought a ticket, after I pleaded my case, the judge looked at me and said something to the effect of "under no circumstance will I disagree with the judgement of the officer, By doing so it would discredit his testimony in all other cases." So if the DA wishes to presue this one, it will go to a jury trial.

My brother hauled his the exact same way you did jeromy and all the way from the big town of henrietta and he got pulled over for a tail light out on his trailer and nothing was said about how he had his loaded. i think they were trying to be pricks that weekend.

Maybe the cop was a jeep guy......Or maybe he doesn't like lexus..

I was told by a friend who is a constable(kindova cop)the same thing, but I don't know if that was about traffic fines or what. I've tried to call him just waiting to hear back.

If I were to the one contesting it I would just take the side of overall width being under 8'6" and say nothing of the way in witch it was loaded since that is not writen on the tiket at all. Play to the strength of lack of evidence
