Engine swaps legality?

So much info and you need to be a lawyer to understand it all.

Can I swap a different motor into my TJ or not?
If I can what are my limitations?

A lot of the info points towards making me think I can only swap in a newer motor from another TJ and that v8 swaps are out ... so whats the deal?


I don't want to put one in if I can't do it legally. I don't mean just that it will pass smog, I want to make sure I won't have an issue 5 years down the road if TX adopts the same wording as the EPA.

Been looking myself.

As far as I know AEV flashes the computer that controls the engine on there hemi swaps with the vin # of your vehicle so when pluged into a code reader all the #'s will match. (like it came with that engine) There swaps are 50 state smog legal.

Swap it and don't look back! Get you a PO box in a non smog county and don't worry about it.

I aint readin through all of that to try and cypher it out, but I am sure there is someone here who will take the time to help you out though.

I'm currently under Travis county emissions/inspections laws.

I placed a call to TXDPS and spoke to a guy named Ronnie.
He told me that it IS legal to swap in a newer or same year motor per TX. Doesn't have to be same manufacturer or an offered option for my specific make or anything specifically.

ALL of the emissions equipment from the new motor and/or chassis must remain. So if the new motor has more emissions stuff on it or the chassis it came from, that must go with it. If the recip chassis had more emissions equipment, the new motor will have to be hooked up to it all.

Rules would be different if I swapped in a diesel but I didn't ask more about that.


I went on to ask him about the EPA crap I listed above ... whether or not it is legal per TX is one thing but I want to make sure I would not have any fed problems or problems with non matching vins or if I'd need a new smog sticker, etc.
He referred me to them. I already have some emails and calls to their people.

Will update yall with what I find out but he seemed like it should be fine on the fed level too.

Do you work for the EPA or a lawyer or Greenpiece. You need to move to a county that doesn't check your exhaust. Or install a late model LS motor with a catalytic converter and it should pass the sniff test.

None of the above if you are talking to me.
If I did I would not have had to ask any questions.

Moving to another county wouldn't make it EPA legal anyway. My point was I want to be iron clad that if I do this and 5 years down the road TX picks up the EPA standards everywhere I'd still be OK.



I have an update anyway ...
I got a message from one of the people I contacted at the EPA.
He is the contact they have listed under "tampering" for the "vehicle engine/fuel/enforcement issues". My hope was that if he is part of the enforcement team, he'd know something about it.

He said (on my voicemail) that provided I use the computer and emissions equipment from the new engine I am installing it is absolutely fine. He said I could call back with any questions.

So, I'm going to call him back tomorrow and dive a little deeper. I'll ask him as many questions as I can so if there is something specific you'd like to know that you think I won't think of please post in here.

I'm also going to see what he says about me getting something in writing or at least an email from someone there ... or if they have another department that could give me something.


I'm still waiting to hear back from the other 2 guys though I know one is on vacation until the 8th.



I'll leave no stone unturned ... it is my nature as some of you are figuring out.

Today he said it must be the EXACT same model. He originally thought the 4.7 was offered in a Wrangler....and if it was ever offered in a Wrangler I could do it, but otherwise, per the letter of the law, not supposed to.

He also said he knows it's done all the time and nobody is going to stop me. Especially since it is legal with the state.
They don't go after people for doing this and that a private citizen can pretty much do whatever they want to their own car. So it seems like the certification process, etc, it setup more to catch manufacturers and they don't really care about the individual oddball.

I didn't ask him about the chassis classification because it doesn't seem to matter at this point.

One down and two more to hear from.

So far, not looking as good as I had hoped.


Oh, the guy I talked to today is named Jim Kellerstrass.

Do you REALLY think that Texas will move to EPA standards? Really? I highly doubt it. I think you're making too much out of it. I put a newer motor in mine (albeit a chevy) and "F" the man if he doesnt like it.

Toylet just gettin started
I'm swapping my 86 yota onto a 83 blazer frame with 350-nv4500-205 right now plan to get it swapped memorial day weekend if I keep at it! I'm not worried. My insp tag goes out in October. The inspector last year said no emissions next time... I thought it woulda been 2011 but I dunno either run it on Denatured alcohol/ gas mix again, or just wait a few months and take in January 2011! LOL
