Divorce and custody ?'s

I know this is a wheelin forum but some of y'all might be knowledgeable on the subject:

A friend of mine who got divorced from his ex a few years ago is wanting to take their two girls (4 and 5) out of Texas for Christmas vacation, for about 2 weeks. The ex wife is claiming its illegal. There is nothing in their agreement making it illegal, but she claims there are laws against it if the other parent does not agree (she isn't agreeing because she wants the power of making him unhappy). He gets the kids for those two weeks irregardless if he stays at home or not.

I won't go into details, other than to say she is a female dog to the highest degree, bipolar- doesn't take her prescribed meds, and she lies.

Does anybody have a good website or info to read up on this matter? Any personal suggestions will be considered as that, and not law, so fire away with those as well

I would suggest he consult with his lawyer and/or the court that rendered the custody decision.

Considering he's the biological father and has joint custody, it doesn't matter where he goes when he has them unless stated otherwise in the judges order. He has as much right with the girls as the ex-wife does. It's not a criminal matter considering it's a child custody affair. He just needs to read the order carefully and make sure it allows it. If it's not mentioned then there is nothing she can do. If he does do it and the ex is as crazy as you make it seem. I suggest he carry the order with him at all times. When the girls are nine they can choose what parent they want to be with.

First off, it sounds like your friend is getting divorced from my ex-wife. You described her perfectly. Def take the decree with him out of town in case she decides to initiate an Amber Alert or some crazy chit like that. I'd ask a lawyer or call the attorney general's office to be sure, but either way, she cannot withhold visitation, and it would be up to her to 'prove' there was anything done illegal.

And kids don't get to pick where they want to live at a certain age (other than eighteen). The court will hear their opinion, and their reasons. But they are not simply allowed to live where they choose.

Unless the parent that the kids wanna go with is that bad, then the courts in my area usually allow the kids to choose. I worked in LE for eight years and dealt with this crap on a daily basis. At nine years old the kids are not considered children anymore, and are able to speak their mind. They can get arrested at nine also. I guess different districts work different, but state law is state law.

I used to think the kids cant decide until my daughter turned 12 and was with her mom for a visit. I have had custody 10 yrs and was served papers on her 12 b-day stating I was being taken to court for custody and a restraining order. My attorney recieved a letter from my ex's att. stating that my daughter signed a letter and notorized. We have been to court since and now my ex has temp. custody of my 12y.old.

Unless stated in the decree....he can do anything with the kids anywhere anytime during HIS VISIT.

hes in san antonio. he always tells me that the guy can call and tell him his problems and stuff for free. so the lawyer will listen and tell your buddy if he can help or not.
