Moving violation

I got my first ticket in 16 years last week and I'm wondering how to handle it. Being new to TX I was traveling down an unfamiliar stretch of road in a lane that "doesn't exist". Although it is not clearly marked and other vehicles were travleing in that non existent lane, apparently it is not a lane. Regardless, I passed a dumptruck on the right and got a ticket for "Illegal pass on the right". They don't mention driving in the non existent lane on the ticket.

I read the TX DL manual and it only says that if you want to pass on the right you need to make sure there is adequate room to do so, which there was. Unfortunatly, if you read the actual law, it says you can only pass on the right if the vehicle is slowing down or turning left, to which I say BS. Lets face it, how many of us have gone around grandma when she is going 45mph in the left lane on the hwy and she refuses to get over?

I tried going to the courthouse and they still don't even have my ticket so nobody will explain the ticket to me.

Anyway, I'm wondering what I should do. I'm not thrilled about paying the ticket but my larger concern it that my insurance will go up. Someone at work mentioned that I could take a driving class and the ticket would go away or something but they didn't have any details.

I'm open to your advice...

Pay it and tell them you want defered judification. It's basiclly a probahtion. As long as you don't get another ticket in 60 day, or something like that, the ticket will be erased from your record. Or you can take a driver's education class and that will erase your ticket.

i took a defensive driving class online and it wiped out a speeding ticket. I think it works on any moving violation, but you should verify with the courthouse before taking it. I think they give you like 180 days to complete it after you inform the court. It worked out to be nearly the same end total as paying the ticket though, plus I had to waste awhile clicking thru the driving class. Deferred judification works too, it just takes a little longer to have the ticket removed iirc.

Thanks for the tips guys. This makes me feel better.

So I just walk in and tell them I want to pay the ticket at the clerk desk or do I need to schedule a date to see the judge or something?

Just go in and tell the clerk you want to defer it. You then pay a fee which is usually about the same $ as the ticket. She will explain the rest. If not be sure and ask how long the "probation" is. There is no need to see a Judge.

Then drive like an angel till the probation is over. If you get another moving violation they BOTH go on you record.
